I'd probably have asked for a comment somewhere explaining the test a little more. Something that also said what to do when it fails (i.e. investigate and fix the regression or call it out during review so we can decide if it's acceptable). We know now what to do, the question is what is someone new on the team (or even us 3 years later) going to do when this test fails? :)
